Annual Fee Increases for Administrative Appeals Tribunal and Migration Reviews Effective July 2024
Effective July 1, 2024, the fees for applying for a review of a decision in various divisions of the Administrative Appeals Tribunal (AAT) will see notable changes. This annual adjustment aligns with the Consumer Price Index, as stipulated under section 27 of the Administrative Appeals Tribunal Regulation 2015.
General, Freedom of Information, Security, Small Business Taxation, and Taxation and Commercial Divisions.
In these divisions, the fee adjustments are as follows:
- Standard application fee: Increased to $1,121.
- Review of a small business taxation decision: Increased to $602.
- Review of certain other taxation decisions: Increased to $111.
- Reduced fee for eligible applicants: Remains at $100.
These new fees will be applicable if the application fee is paid on or after July 1, 2024, regardless of the actual date of the application lodgement.
Migration and Refugee Division
The adjustments in the Migration and Refugee Division are as follows:
- Review of a migration decision under Part 5 of the Migration Act 1958: Increased to $3,496. If a 50% fee reduction is granted, the fee will be $1,748.
- Review of a protection visa decision under Part 7 of the Migration Act 1958: Increased to $2,151. This fee is generally payable only if the application is unsuccessful.
These fees will be applicable for applications lodged on or after July 1, 2024. Additionally, for applications lodged before July 1, 2024, the new fees will apply if the payment (or 50% of the fee with a fee reduction request) is made on or after this date.
This annual fee adjustment is mandated by the Consumer Price Index under regulations 4.13A and 4.31BA of the Migration Regulations 1994.
These updates reflect the ongoing efforts to align fees with inflationary trends, ensuring the sustainability of the review processes while maintaining fairness and accessibility for applicants.
